Smoking
Posted by CMASAThe new Smoking legislation that affects all facets of the workplace in South Africa has been approved by Parliament and at the time of going to press is awaiting signature by the President prior to being published in the Government Gazette. We are unsure as to the date this will take place, but will keep members informed.
In essence, the new amendments prohibit smoking in the workplace and employees who were previously required to sign an indemnity whilst working in a smoking area are not required to do this any longer. You may not dismiss an employee who refuses to work in a smoking area. Penalties for smoking in a non-smoking area are stiff both for the "owner" and the smoker. The new legislation also creates a "no-mans land" before entering a public building (this to prevent people hanging aruond outside doorways). The previous legislation relating to providing not more than 20% of floor area for smoking to a "bar" or "restaurant" still applies. Individuals under the age of 18 are in terms of the amendments not allowed to accompany their parents into a smoking area of a restaurant. Patios that are covered and have "drop-down" sides are now seen as "inside areas" and smoking is prohibited therein (unless of course you provide seperations and have proper exhaust systems in place) - this applies to internal smoking areas as well.
Clubs seem to be finding it difficult to convince their members that the no-smoking rules apply to their clubs, but the fact that the club is an employer places them without question in the arena.
South Africa is following a worldwide trend of no-smoking in public places and I was personally amazed at how "Londoners" have obeyed their new legislation. I never thought I would see London Pubs with no smoking inside......
TOURISM BEE CHARTER
